$7M civil lawsuit filed in Bay Bridge crashPublished 06/17/09
The family of the truck driver who died after his rig plunged into the Chesapeake Bay following a crash on the Bay Bridge last year has filed a $7 million lawsuit against the teenager responsible.

Mr. Short was a professional driver, and Ms. Baldwin was not. She made a critical mistake when she got behind the wheel of that car and made the decision to drive. Mr. Short would never have made that trip if he were that tired or drinking alcohol prior, for that matter ! If the shoe were on the other foot, and Mr. Short had killed Ms. Baldwin, he would be sitting in jail, facing huge fines and an even bigger than $7 million lawsuit. It's an insult and a slap in the face of the Short family to allow this immature young lady to get away with a small fine and no real repercussions other than replacing her totaled car so she can drive again. Mr. Short is not able to go home and enjoy his family... he's busy taking a dirt nap. My support and condolences go out to the Short family and I sincerely hope the MD legislature reforms some of these legal loopholes that allow this kind of injustice to occur !

William Cooke gives a good explanation of the law in this instance. The problem is that the laws are too lenient. Of course Miss Baldwin didn't mean to kill Mr. Short. However, it's simply not acceptable for her to be allowed to just pay $470 and not even have to appear in a court of law after her actions resulted in someone's death. She should have at least been sentenced by a judge to a public speaking circuit about what can happen to people who drive when they shouldn't. TIRED OR DRUNK! No matter what the charge, if someone dies, the accused needs to answer on the record in a court of law. Not just be allowed to send in a check to cover the fines.

It may not be legal, but it is not enough to charge her with a death. You still need to show criminal negligence or at the very least that she was negligent and impaired by alcohol in some way. It is simply not enough to say that she had some alcohol in her system, was driving, and that someone died.

The argument that Miss Baldwin was drinking and driving is not being disputed. The pictures provided by the lawyer to the newspaper were apparently available because Miss Baldwin posted them on her My Space account. They do not prove negligence in this specific incident, however, it is her mistake that they were available to be published. Anyone using a social network should use careful thought before they post any information or pictures.

Yet "...prosecutors decided not to charge Baldwin ... with auto manslaughter, since her blood-alcohol content was below the state's legal limit for drunken driving".

She was not charged with DUI as the photos would suggest. She was well below the limit only two hours after the wreck. Many things can be said one way or another about BAC limits and age of drinking, but the Capital is using the photos to suggest something other than the facts.

I don't see the connection between underage drinking and drinking and driving. As noted before, I never drive over the limit, but when I was under 21 I had a few drinks. The drinking age should be abolished, or at least moved to something reasonable, like 14.

I don't care if you're 19 or 39 - NO ONE should drink and drive! Especially if you are tired and it's the middle of the night. Almost everyone in Annapolis was affected by this "invincible" young driver that day, maybe more young people can learn from her mistake. My thoughts go out to the Short family and I wish them luck.
