The Court of Special Appeals, the state's second-highest appellate court, on Thursday upheld a July 2007 Circuit Court ruling to that effect.
"I think it's pretty definitive," said William M. Simmons, the attorney who represented the five residents in the 5-year-old lawsuit. "They (the association) have ignored this area for 35 years."
