In the wee hours of the morning Monday, Chesapeake Bay Crab Cakes vacated its corner stall in the Market House downtown, leaving only Vaccaro's Italian Pastry Shop and BankAnnapolis remaining.
The departure of the crab cake shop caps off a year and a half in which nine of the 11 businesses have closed in the downtrodden downtown historic building.
The management company continues its lawsuit over the Market House in county Circuit Court.
Calls to Chesapeake Bay Crab Cakes management were not returned before press time, but representatives from the company who asked to remain anonymous said extremely poor sales were the main culprit for the closure.
Employees were informed of the closing Christmas Eve, the representative said.
In 2006, the city of Annapolis agreed to a 10-year, $100,000-a-year lease with Market House Ventures, a subsidiary of Silver Spring-based Site Realty Group, to manage the iconic property.
That was after renovations were made after it suffered considerable damage from Hurricane Isabel in 2003.
Vendors moving into the Market House when it re-opened in July 2006 complained to both Market House Ventures and city officials that the cooling system was inadequate for many of the businesses.
By October 2007, the system forced Fractured Prune and What the Fudge to shut down their stalls.
A few months later, Market House Ventures sued the city for $2 million, citing the city's failure to fix the faulty cooling and heating system. The company upped the lawsuit to $6 million two months later in February 2008.
In May, Waterside Pizza, American Grill, and Gourmet Commissary and Sophisticated Sweets left the Market House. Galway Bay, the Fresh Stop and Auntie Anne's Pretzels left in September.
Several of the former vendors intervened later that month in the ongoing lawsuit over the Market House, lobbing complaints against Market House Ventures and the city.
"It's sad, but its part of the progression," said city Central Services Director Robert Schuetz. "(Market House Ventures) has tremendous control over the situation right now."
The city is only in the third year of its 10-year contract with Market House Ventures.
Calls to Market House Ventures and its attorney, Neal Hyman, were not returned.
Earlier this month, the Washington, D.C., city government dropped Site Realty from managing its historic public market, Eastern Market, which Site managed through another subsidiary called Eastern Market Venture Inc.
Washington, D.C., officials said Site Realty violated a slew of lease agreements, including entering into contracts exceeding $25,000 without the city's approval; failing to maintain its nonprofit organization status in the district; not registering with the city Office of Tax and Revenue; and failing to monitor tenants for sales and use tax registration, liability insurance and business licenses.
Annapolis city officials said Site's lease agreement is a completely different situation from Site's agreement in Washington, D.C.
Annapolis Mayor Ellen O. Moyer said that Site was taking over an existing lease in D.C.
"We would love to get out of the contract. (Market House Ventures) has not been very good partners. We've had three years of bad management," Ms. Moyer said.
Nikki Roden, a manager at Vaccaro's, said company officials told employees it plans to stay at its Market House location until it can find a better location or until its lease expires. She said she was not certain about the date the lease ends.
Market House Ventures has exclusive control of the interior design and layout of the Market House under lease terms.
Mr. Schuetz said that in the next few days, city inspectors would check the vacated stall for safety and electrical and plumbing hazards.
City officials said that they have been referring businesses inquiring about leasing space to Market House Ventures, but the management company has been non-responsive.
"Nobody in their right mind in these times would agree to a lease with (Market House Ventures)," Ms. Moyer said. "We're pretty handcuffed. You could bet that there would be a whole lot of things different if we had our way."
City officials suggested temporarily holding art shows and exhibits during the boat shows this past fall and selling cider during the New Year's festivities tonight, but Market House Ventures declined.

How about if the City of Annapolis rents the building to CASA of Maryland for a job training center for illegal immigrants? They can hand out drivers licenses, find jobs for illegal immigrants, etc. If not, it can always become a Rent to Own or Dollar Store or even a good liquor store ? one step closer to being a dead business district. At least the city of Annapolis will not have to spend the tens of thousands of dollars to retro-fit the Market's undersized HVAC system. And all is not lost, there is still time for the city to remove the portable A/C unit in the parking lot and start collecting the parking meter revenue again.

"harry trampolini", the market house existed for YEARS with the city as a landlord. The problem isn't that the CITY doesn't know how to manage real estate - it's the Moyer administration. The former tenants of the market house had no problems under previous administrations (or, if they did, they were nowhere NEAR the headaches they got from the Moyer group - ONE of them had been there for over THIRTY YEARS). I know one thing for sure - no previous administration tried to run the market house tenants as a group out in favor of a two-in-the-bush arangement with an outsider to take over the entire bulding. Well, at least I know one person who's happy about the current situation - they crammed the old city message board with rants about how good it would be for the city to get rid of the old tenants in favor of Dean & Deluca or some other fancy-pants niche marketeer. Right, FleetStreet?

Market House - January 5, 2009
When we acquired the Annapolis Marine Art Gallery in 1998, the busy Market House and City Dock were synonymous. Since then the City Council's "privatization" of the Market House has been the equivalent of a neutron bomb, in which all the renters are wiped out, and only the buildings remain standing. Everything within a radius of several blocks has been irradiated too. In December I emailed the mayor. I wrote, "As a merchant who has been adversely affected by the near-vacant Market House, I'm wondering if you can tell me what the City of Annapolis' plans are for putting this vital centerpiece back into operation. Ever since we testified years ago to an apathetic planning group and advised against wholesale change to this Annapolis institution, the project has become a monument to failure, and the merchants of the City Dock area have paid the price. Her response to me was predictable. "Dear Mr. Schaub," she responded, "The City Council decided to privatize the management of the Market House. Businesses in general supported this recommendation pushed by Alderman Louise Hammond. The City entered into a contract with Site Realty to manage the Market. Contracts are not easily broken. A judge will ultimately decide the contract issues. Sincerely, Ellen Moyer, Mayor" This is sanitized drivel to describe what happened in 2002-3. Businesses were NOT for the change. We warned a half-asleep Planning Committee that there was a grave danger in 'modernizing' such an historic structure. The mayor has apparently decided that blaming everyone else is the best way to go. Unfortunately for her, this derelict will define her mayoralty for a long time. The problem is not what happened. We can bitch about that forever. The problem is how to fix it, and fast. Somehow, though, what happened recently makes me cynical about fixes and how fast they'll take place.

downside for downtown - January 2, 2009
The Market House situation is a problem for downtown visitors, but perhaps more importantly, Annapolis merchants. There is enough blame to go around, but this continuing dysfunction is unacceptable. We know the City should have been more comprehensive in the redevelopment. There is a great wealth of professional, private sector advisors in Annapolis, many own downtown retail buildings. They know how to structure a lease and manage construction. They could have been, (and still can be) called upon to 'contribute/donate' their services to resolve this problem. The original lease terms were onerous, and the 'complexity' led to problems. The city should have architectural oversight, but the historic society overview is already in place. The City does not have the expertise to manage real estate. The Market House dysfunction apparently was due to lack of HVAC capacity. Where is the engineer who designed the plan? This is no longer about heating and cooling components. The Market House should be a greeting station for vistors for quick carry out, and whatever the 'market' supports. It is equally important, in times of tough 'market' competition from two malls, that downtown retailers get involved to protect their interests. If a tenant is violating his lease there should be lease terms to correct or evict. There are many professionals in Annapolis who could provide advice, but action has to be taken quickly.

The Democrat Mayor and City Council peed on the wedge fries and made them 'better'. I also used to bring folks here to the Market Place for snacks, treats and lunches but now I can't because liberal idiots ran the ship onto the reef....and blame the weather, the reef, ad nauseum...anybody but themselves. Ask the Mayor, she'll say "It's in the Court's hands". Another bunch of idiot liberals. I suggest bringing in your own potatoes and frying them yourself. Oops! There is a law against that! Well then leave your taters, milk cream, fish, and tomato sauce at the Mayor's doorstep for a few days. The STENCH might make her do something after a few days. Why can't she keep the market alive? Folks in the 1700's did it, Why can't she? After 2 years anyone would conclude that the Mayor is either an Idiot or corrupt and the City Council is not far behind.

The Old Market House - January 1, 2009
My fiancee's parents were talking about the Market House last night at dinner. They reminisced about the cozy atmosphere and the quaint little vendors like the vendor who sold the chicken sandwiches and wedge cut fries (where did they go?). They are from Montgomery County and said the old Market House was why it was fun to come to Annapolis. It would be great if we had politicians that would come clean and admit that they made a mistake. Then, we would not have situations like the Market House debacle. Someone remind us again when the Mayor's current term ends? :-)

Mayor Ellen Moyer acts as though the city has never had an opportunity to run the market house. She forgets (rather conveniently) that the city RAN the market house until the lease with Site Realty. And what a fantastic job they did, too. They forced the old tenants out because the city had been secretly negotiating with Dean & Deluca to take over the entire building as a gourmet grocer, but D&D backed out of the deal and the city was forced to find a new tenant. Frankly, I don't know if the market house can HANDLE another round of the city having its way.

The Mayor acts like the City's hands were tied in signing the 10 yr. lease with MH Ventures. Last time I checked, an agreement needed to be approved by both parties in order to be initiated. Who was the baffoon at City Hall who ultimately approved this one-sided lease and is ultimately responsible for this fiasco?
