Dobbins Island battle back to square one

It could be back to the beginning for Dobbins Island.

The Maryland Court of Special Appeals ruled yesterday that two environmental groups can appeal David Clickner's plans to build a house on Dobbins Island.

The decision reverses a 2007 ruling from the county Board of Appeals that kept the Magothy River Association and the Chesapeake Bay Foundation from challenging a county finding that he could build on the island.

It also potentially sets an important precedent, giving environmental groups the right to challenge local zoning decisions, lawyers for the foundation said.

the saying goes and no man should be allowed to destroy the public waters for generations when his stay on earth is limited and "owernship" short lived and passing. I am glad the judges recognized the "others" right to protections of the bay waters and that the people, state and nation have invested millions in preservation of the Bay. This guy not only polluted the Bay, he knowingly and willfully broke the law to meet his own personal gratifications. He just couldn't take no for an answer. There is a name for that: arrogance.

Here we go again with the bay gustapo.I am so glad I dont have anything to do with the chesapeake bay.Whine whine whine about it over and over again.Maybe Paul should have dished out the $850,000.00 back in 2004 and he wouldnt have this problem.Oh wait then he'd be responsible for keeping this property clean because he would own it.

MRA and Mr. Spadaro have been doing good works for Magothy and the Bay. The environmental issues and the Code are clear. This case and Mr. Wagners flaunting of code provides insight to the skewed procedures in permitting process. All persons are able to appeal in multiple forums. Citizens requesting adherence to the code are forced to pay thousand just to assure code is enforced, the legal costs can easily be $50,000. Expanded density or variances are gains for developers, one additional lot is worth $100,000. The 'standing' issue was passed to limit concerned voices. This change was passed by the Council at the request of the development community, (similar to impact fees). The health of the Bay affects us all. The Board of Appeals ( second stage in the process) approves most variances requests and liberally interprets the code. The board has expanded their authority, without having the professional qualifications to making their decisions. They are more of a political forum. If you attend or participate you witness the often arrogant and unprofessional behavior of the board. Citzens are Anne Arundel County, board members are there to listen and should respect all who come to express their case. Thankfully MRA had the resources and volunteers able to get before a judge and secure an objective opinion. Mr. Bluementhal needs to get off various 'quasi-governmental' boards, such as the Liquor Board where there are conflicts of interest. The same 'players' in the legal community keep coming up. Objective oversight and enforcement is good for all.
