Judge dismisses Constellation appealPublished 07/03/09
BALTIMORE (AP) - Constellation Energy lost a round in its battle with Maryland regulators over its proposed deal to sell half its nuclear operations to France's EdF when a judge ruled yesterday it could not appeal the decision to review the agreement while the review was under way. The Maryland Public Service Commission is looking into whether the $4.5 billion deal is in the public interest. The PSC doesn't regulate Constellation, but regulates its Baltimore Gas and Electric utility subsidiary. were built by the people of MD after much debate about the pros and cons of the dangers of nuclear waste going into the Chesapeake and the long term need for MD residents to have affordable supplies of electricity into the future. BGE was a "profitable, well run" regulated monopoly with assets lusted after by Constellation Energy. With de-regulation in 1999, the people of MD got short changed.
The PSC is now doing the job, that it failed to do under former Gov Bob Ehrlich. Some may say that re-regulation is putting the genie back in the bottle. I say perhaps it is time to open a new bottle. I am glad the PSC is doing its job and the judge upheld the state's right to protect its people.
