I keep hearing the arguments for and against stringing this officer up by his toenails for animal abuse. In my personal opinion the dog should be alive today, I'm a dog lover and I've even been attacked by a dog. We both live to tell about it.
Here's a point that a lot seem to get and I doubt ANYONE can argue with...
"WHY DID THIS GUY HAVE A GUN IN A PARK?" Officer off duty or not we have a problem when an a guy brings a loaded weapon to a park for a walk with his family.
Here's more for your reading pleasure. These are personal friends of mine who found themselves in a similar scenario over the loss of their pet. I rallied with them. This "officer" was a REAL winner and it wasn't his first brush with trouble on the force either. Differences? This officer was on-duty and using his service weapon. Similarities? Both officers are trigger-happy and a major liability to the state.
An animal abuser? Maybe not so much. A liability to the state for being trigger-happy? Most likely!
I hope kids don't spook him when they play.

My father was a DOD police officer. He HAD to lock his servic piece in a locker before he left the base. Why this yahoo was allowed to carry his service piece - with hollow-point bullets, no less - off base makes me wonder if he really did it legally. As to are the cops covering for him: whose word did they take - the dog's owenrs' or the cop's? There you go. And why did he "need" to carry his gun to the dog park? It just seemes he went hunting ...he needed to "cap" a dog, as so many of you say.

what is a shame is that this has turned into and election year political football.. I think I understand what you are talking about in regards to that decision. Essentially saying, punitive damages will not be awarded in the case of a killed pet, you can only recover the cost. It will be interesting to see whether a similar ruling is made here during the civil trial.
Had those been the same circumstances in MD and Shephard sitting in his front yard and shot Bear-Bear, we wouldn't be having any of this disussion. This would have been an open-shut case. Fortunately, in MD, if an animal enters your property and bares it's teeth at you, you are justified at using any means at stopping it. A bit different here as the property was essentially a neutral area.

It was not a sever year old case, as it was decided May 21, 2010, and the court researched case law throughout the country. In the most recent Maryland case (Myers v Myers) in Fredrick county the court held that "Under Maryland law, family pets unlike, children are treated as jointly owned marital property and sold if the divorcing couple cannot agree on who gets to keep them. The parties then split the proceeds of the sale."

A seven-year old case from Vermont does not constitute a precedent for the decision of a Maryland Court at any level. Further, you do not know if Bear-Bear's owners plan to pursue the same civil charges as the couple did in Vermont. In addition, the shooter in Vermont was on his private property and used a pellet gun, not a 9mm loaded with hollow points.
These cases are far too disparate to reach any conclusions or project any outcomes using the Vermont case as a legal template.

There was a similar case involving an Annapolis couple, Sarah and Denis Scheele. In July 2003, the Scheeles were visiting from their home in Maryland when they stopped in the parking lot of a church in Northfield, Vermont. While in the lot, their unleashed dog, Shadow, who wandered onto an adjacent property. The owner of that property, Lewis Dustin, was sitting on his porch with a pellet gun shot Shadow, killing him. Shadow and had not exhibited any aggressive behavior, posed any threat and Dustin was not in any physical danger. Shadow died as a result.
The Scheeles sued Dustin seeking noneconomic damages for mental distress, emotional pain, and destruction of a special relationship. They claimed that the real worth of a pet is not merely financial and cannot be measured solely by the replacement value. The Washington Superior Court (equivalent to Maryland Circuit Courts) barred such recovery, holding that Vermont does not recognize noneconomic damages for the malicious destruction of personal property, even when the property is a beloved pet. The Vermont Supreme Court affirmed, saying Vermont law views animals, including pets, as a form of PERSONAL PROPERTY. Hopefully, if a civil suit is filed in Maryland, the same decision will be made.

Looks as if they published the street name and the block he lives on. In the article one of his neighbors mentions that he (Shepherd) is saying that "he doesn't feel safe."
The neighbor lady says to the reporter "How does he think we all feel?"

Whats even more annoying is if police have a different standard of consequence for doing STOOOOPID things with a gun than a person without a badge. Shouldn't happen, sometimes does. I don't really care about dogs, which is why I dont have one anymore. I dont really care about cops, which is why I didnt become one. I care about fairness. Its not fair if a cop can start shooting ANYTHING in public other than criminals and terrorists. If I cant shoot someone elses dog for annoying me and get away with it, NEITHER CAN HE. And trust me, I know for certain that if I did, my new name would be inmate 4395867. So wether you are a dog lover or not, or a cop lover or not, the fact remains that he CANNOT be treated any differently than any other citizen in reguards for f-ing up. One of the benefits of forums and posting boards is that those of us who posses a mature world view, one that recognizes the vale of differentiation of opinion, can at least be mildly entertained by people like Lee. They serve as the comic relief in an otherwise depressing story...Rather as the court jesters in time of war. Distracting, but it is not their intent to be taken seriously. Usually I'm right there with you, Johnathan, put this time I must correct you. All police agencies that I am aware of use hollow points as their duty rounds. AAPD used to use the Hydra-Shok but within the past several months switched to Speer's Gold Dot which is still a hollow point round but is "bonded". It makes it a tougher round and better to penetrate laminated glass, aka windshields.

Shepherd is a sociopath with horribly poor judgment, and he should not be allowed to carry a weapon because he obviously has absolutely no idea when he's supposed to use it. I think that you should give classes at dog parks to let everyone know what to expect from Husky Rescue Dogs being handled by the mentally retarded and what to do if they are playing rough with your dog.

I was absolutely devastated when I heard the news about Bear Bear, that piece of property was so well loved. I did not realize that everyone on this page was a dog whisperer and truly knew what Bear Bear was thinking that day. Could you teach me to talk to animals. If you would have been there, maybe you could have told Bear Bear to calm down. I bet if you were there the other answer to killing the dog, would be singing to it or offering your arm as food.
Thank you for explaining the rescue as I have never heard of that before. I am sure that the rescue knew that a mentally disabled person would be taking Bear Bear out by himself, especially as you imply Bear Bear was neglected in the past.
It seems like a theme as you continue to say that all police have an abuse of power. You are correct, I know they do the job for the large sum of money, easy hours and the fact no one second guesses them. The same reasoning can be made for other vocations as all teachers sleep with there students, all politicians use cigars on their interns, and even Iraq still has weapons of mass destruction. I hear police officers shoot dogs everyday in Maryland and it is getting worse. Marie I am so glad we are friends and would be scarred of you if I was a police officer.

You keep chanting "you weren't there" as if that changes the simple facts of the situation. It doesn't.
Bear-Bear was not attacking Shepherd or his dog. Bear-Bear had a solid history of being non-aggressive and friendly to men, women, children and other dogs. He was in that dog park up to 3 times a week. Everybody in the area who took their dogs to that park knew and loved Bear-Bear.
Shepherd says Bear-Bear bit his dog. But he didn't. That was proven when his dog was examined. Shepherd says Bear-Bear tried to attack him. Then how was he able to shoot Bear-Bear from the REAR? Was he able to teleport behind him or something? Neither Shepherd nor his dog had a single scratch on them.
Shepherd says he was afraid for his life. That's because he's covering his ass. He knows he wasn't supposed to shoot that dog, and he knew what to say to the police to minimize his accountability.
Furthermore, huskies play roughly. They get on their hind legs and wrestle. Guess what? That's exactly the behavior Shepherd himself described in his own report - except he called it aggression. Because he was too stupid to know the difference.
The only reason you are arguing against this is because you haven't done any research on this case and you may be just as ignorant about huskies as Shepherd is. There is no justification for using a gun on a dog in a dog park. NONE. Normal citizens can break up dog fights without using lethal force, why couldn't Shepherd? Why didn't he even TRY any other method? Have you asked yourself that?
He is a gun toting psychopathic sociopath, and the fact that he drew his gun FIRST, before trying ANYTHING ELSE, should be a MASSIVE RED FLAG. There is nothing to defend, everything he did was wrong, from start to finish.

It doesn't sound as though you were there, either. Sadly, it is true that because this man is a police officer, and because there are not stricter laws protecting animals (as they're only viewed as property, not living creatures), this case will never see true justice.
No one writing a comment on this page was there, true. But as animals lovers, we understand their nature. We understand how dogs interact with one another. I'm surprised and shocked that an officer with a canine companion doesn't understand. Killing an animal is not the only answer. If his dog was in any danger at all, I am sure someone would have intervened.
What's more, this dog was from a rescue. You probably don't really understand what that means. But rescues don't allow their dogs to go to anyone but the most responsible pet owners because that is their job. You can't possibly blame the dog's owner for neglect. He would have intervened if the officer's dog was in danger. There is a strict screening process rescue's go through (applications, interviews, home inspections, etc).
The problem is the abuse of power some cops, not all, and certainly not most, are exercising these days. There are controversial stories in the news all the time about cops using tazers and excessive force on the elderly and children. It is a trend that needs to be stopped because it is continuing to get worse.

Just to add a few notes, The officer that shot Bear Bear will not serve one day in jail, most likely will not be found guilty of anything criminal. As per his departments regulations, he was defending himself and was well within the policy. I do not agree with this officers actions, even though I am amused to find that many of you feel that all police officers go to dog parks just to shoot, kill, maim, and bludgeon defenseless animals. You all were not there, so your testimony on this website it truly compelling, but at the same time worthless.
In the military and law enforcement community using the lethal option is the last resort option. At no time is a shot in the air, warning shot, shot in the leg authorized. You shoot to kill. Truthfully if both dog owners had done their jobs by watching over their dogs properly, this never would have happened. The officer was justified to use his firearm to protect himself and family. Again you all were not there, so how would you know.
I am so happy there are so many comments on these pages related to Bear Bear, instead of the multiple shootings last week in the county, the home invasion in Severna Park, the murder suspect being caught, and not to mention the international incidents where there was other loss of Human Life. I can understand why you think county police are so corrupt. I think they are too, they caught a person that burglarized my house while they should have been investigating this incident. They are investigating other crimes instead of devoting every single officer to Bear Bear. How dare they. They need an officer at every dog park, every vet, and a full contingent of officers at Bear Bears funeral at Arlington National Cemetery.

That wasn't exactly what I said but you are correct, it doesn't matter.
I cannot speak for WJLA. I do know that I was reading articles, nearly simultaneously between the Sun and Capital.
I actually got confused as in the Capital I would read that the police were withholding his name.
Then I would read that his name was Shepherd in a Sun article. Thus I decided to look back and found an article where the Sun mentions their non-redacted copy.
I'm certain the Capital knew his name also but they have a long history of "police cooperation" if you want to call it that.
The Sun hardly has the same sort of reputation.
What I am getting at is the police would still be withholding his name if they possibly could simply for the fact that he is a cop. No picture, no address which is hardly the norm in any criminal case.
This case is on a criminal docket, misdemeanor or not.

Do you know how a dog would react. Obviously from that comment you don't. I have a yellow lab that is field trained and part of that is not reacting to a gun shot. Again not saying I agree with what he did, but know he's supposed to assume that this dog would just be scared. My point was and is that if an officer as a last resort draws his weapon it's to shoot someone, if there's other options they won't shoot. The only sad part of this saga I see (other than the death of a family's pet), is it took a large public outcry in order for this incident to see the light of a courtroom.
When will prosecuters and DAs in MD grow a set and not wait until they gauge public sentiment before they make their decision whether to file charges or not.
I don't know of a single department that requires the loading of hollowpoint ammo into their service weapons simply due to it's inability to effectively penetrate car windows and body armor.

You seem to forget this is a dog we are talking about. How many people have you seen run under a table when fireworks are going off? If Shepard were not a dog owner I might be able to cut him some slack for not knowing how a loud gun retort would effect a dog. Yes it is a start. Too bad he won't go through the indignity of being handcuffed and booked.
The best thing is that this likely makes it easier for the dog's owners to file and possibly win a civil suit. It shouldn't cost them a dime as most attorneys just want the plaintiff to sign off for one third of the award.

Regarding the "hollow points" and "hydroshock bullets"; first, most officers are required to carry ammunition that is issued by their agency - even in their personal weapons. If it is not issued, they are required to carry a specific brand, type, and bullet weight.
Second, they are Hydra-Shok (NOT Hydroshock or Hydro Shock) which is a brand name of a specific type of round manufactured by Federal Ammunition.
With VERY few exceptions all officers are issued or required to carry hollow point rounds. Why? Because they are designed to expand and remain inside the target and not to over penetrate and exit the body. Obviously a bullet that goes through the target and continues on is a hazard to bystanders.

I've read this story from it's beginning. So many questions come to mind. Dog parks are all off leash. Asia 's parents kept her on leash. Wife became nervous (obviously hadn't watched Cesar Milan) when Bear Bear approached. Had Asia been in the park before on or off leash and how did she react? Were there other dogs in the park while Asia was present at other times? Any witesses?
Mr. Shepherd, in my opinion, over reacted and over reached causing the death of Bear Bear.
The justice system (his legal team) will claim PTSD. How long since he left the war zone?
My husband is a decorated war veteran. I respect our warriors...but this is to the extreme...murdering a dog and maybe using ptsd as a defense is indefensible

I think in the road rage case there is a reasonable public expectation that the gun-toting murderer (who is not a police officer under any haze or protection of whatever the law might be regarding his permission to carry) will be charged, found guilty and sentenced.
Certainly, no professional fraternity could have been accused of initially rallying around to cover up for "one of their own".
Under those conditions, one is generally less incensed because you see the wheels of justice turning as they should.
Does that satisfy those who keep raising the question of "Why the dog and not the person(s)?" The facts of the case(s) are just that different.
Finally, to make the absolute moralistic suggestion that until and unless the world goes totally vegan there should be no protections against animal cruelty whatsoever, lest we be (your word) hypocritical, is about as simple-minded as one can get.

People are commenting on this story because it is the story they wish to comment on, as this story to some individuals is important as is the road rage story. You seem to lack the empathy to understand that some people accept and love their pets as family members and the loss of ones pet can be devastating. This guy, being a trained professional could have shot his gun to the ground or sky and had a positive reaction. You also don't seem to have the ability to discern between the love of pets and the farmed animal for consumption...let me explain it to you, if I raised the chicken or cow I had for dinner this week as a pet I probably wouldn't have it for dinner since a caring loving relationship was created. I understand that they believed that this act gave this thug the right to carry his handgun in this State while off-duty.
However, I believe he still should have been charged with wear, carry, and transport of a handgun regardless. His actions were still in violation of Maryland law and if I had been the State's Attorney I would have argued that the Law Enforcement Officers Safety Act is unconstitutional as nothing in the Federal Constitution gives the Congress the right to regulate the local gun laws of any State. Congress overstepped on this one, as usual.

We had a similar case not that long ago where a guy, Philip Balboni, took a dog in his care to a park in crofton where he shot and killed it. He was a regular citizen and he received 60 days on an animal cruelty charge but his gun charges were nolle prossed.

The same case could be claimed by the Baltimore Officer that shot someone for groping his girl in a bar. He could claim that he was in "danger" from the person he shot. I think the fact that he was charged means that the States Attorney didn't buy that claim so it is time to have a trial to determine if that claim had merit.

I'm still not sure why he wasn't arrested for shooting a gun in a public park. I guarantee you that if it had been a "normal citizen" they would have been arrested on the spot. A misdemeanor for that seems like very light punishment.
One thing I'm happy about is the animal cruelty charge. It's not nearly as severe as it should be - a dog died, for god's sake, and for no reason - but it does indicate that they understand that Shepherd was lying through his teeth when he said Bear-Bear attacked him. He was trying to use the self defense argument, but there is too much evidence to the contrary. And that bodes very well for the Rettaliata's civil suit.

Although I agree the dog didn't deserve to be shot, it is pretty sad in a way how the County State's Attorney really is only charging this man so he can save his own hide. Since they aren't charging him with a real handgun violation, they basically are saying he had the right to carry under the Patriot Act as a federal law enforcement officer. If so, and he truly believed he was in danger, or his wife was, he could have discharged his weapon and that would be regardless of how close it is to an occupied structure. The only possible charge that is realistic is the animal cruelty charge. Whether there are implications at his job in Virginia will really be the only way that he wouldn't be able to carry a firearm because he isn't being charged with a felony. It is a confusing issue, and I don't support the dog being shot, but if the attorney's office didn't really have charges on the man they didn't have to do it.
