Dobbins Island subject of yet another lawsuit

Magothy River advocates who want to preserve Dobbins Island are suing the island's owner, saying he broke off negotiations to sell the landmark to conservationists.

In the latest court case, an environmental group claims the public should enjoy unfettered access to the island. Behind it is Little Island, another disputed island where a home was built without any permits.

The lawsuit - similar to one thrown out by a judge a year ago - asks the county Circuit Court to declare that the popular island is accessible to the public and that a fence installed on the beach by island owner David Clickner to deter trespassers is, in fact, on public land.

And the lawsuit asks that no construction be allowed on the island until that matter is settled. The suit was sent to Mr. Clickner's lawyer on Thursday.

Wow - August 7, 2008

The MRA saying that the public should continue to run all over the island freely is rediculous. Just because you have done it for so long don't make it right. When kids play in an empty lot, which later gets a house built on it, can they still roam as they want all over that property? Um, NO... Yes, the owner put up posts along the shore, with chains stringing through them, and we go out to Dobbins every weekend and let the kids play and grill and swim. I have yet to see the waterline come up to those posts. There is always plenty of beach to run around on. I wish I could buy it. I would take donations from folks, maybe 5 or 10 bucks for the day, and have porto potties on it, maybe some other fun things to do for the kids, and use that money to keep erosion down. I still wouldn't allow climbing on the island though. Have you seen the cliff on the southside?

Liz I would not live in Anne Arundle County again even if you paid me to ..... I am very happy with where I live now thank you! More people on the shore care about what goes into their waterways, that is part of the reason the health of eastern shore waters is better then that of AA Co. rivers. Yall can have your dead Severn River, and the Magothy isn't too far behind! Who is going to want to live on an island after everything has been killed off and the bay is merely a sespool that sperates east from west?

Dobbins Island has ALWAYS been Private. I know you tree huggers toured the island illegally but you think since you didn't get arrested you thought it was OK/a free-for-all. The island belongs to sombody, just as your land belongs to you. You will still be able to play to the high water mark on Dobbins but you can't trash the place anymore. The owner has an invested interest in NOT letting it wash away so it will probably stop shrinking. So stop your Liberal whining and worrying about something that does not and never did belong to you.

Bay Grasses - July 15, 2008

It doesn't matter how much bay grass someone plants, if you eat seafood, drive a vehicle, use electric, live in a house (built on wooded land), use products produced in factories, eat farmed vegetation, fruit or animal, then you are a contributor to "raping" the land, air and waters than you might care to admit.

Kristina and your family for all your efforts in helping preserve what we both obviously love. If only more people were respectful of nature and pro-active in working towards bringing about positive changes to the state of our environment, the Bay wouldn't be in the situation that it is today. But regardless, I would like to have all the facts of the situation before making judgment or assumptions on someone's motives - that's why I question everything.

Yes I do contribute to the CBF. My family is also the ones who pick up trash that others carelessly toss on the ground while out on nightly walks or visiting our local parks. My children know what goes on the ground ends up in the bay. We also have been involved with planting bay grasses & with rebuilding of oyster beds. Not everyone agrees with my views, but no one can accuse me of not caring or practicing what I preach. the community we live in was featured on Outdoors MD for going above & beyond with efforts made to preserve the wetlands along the Tred Avon River & we do not do anything with out first thinking about the impact our actions have on bay. Like I said yall might not agree with me, but I do take my part in helping to returning our bay to a state of good health.

why does everyone assume Mr. Clickner doesn't care about the environment just because he wants to build a house on his land that nobody else could or wanted to buy? There are lots of houses on the Magothy - is there a regular check up on everything they do to their places as well? Who says this man doesn't plan to build in an environmentally friendly way? Has anyone bothered to find out or is everyone assuming this man is out to destroy the island, its inhabitants and the Bay - which would really be kind of stupid if he wants to live there. And why just because some people have been trapsing all over this land does everyone think they have a right to continue to do so? Do you also think you have a right to go into a farmer's field and pick his corn just because you want it,it happens to back up to a public roadway, and the farmer may not be able to see you do it? Or that you have a right to get onto someone's dock just because it extends into a public waterway? One more - how many who are so upset by this actually contribute to CBF or any other organization that works to preserve the environment? I have found as someone who does contribute to environmental groups that lot of people like to speak their opinions but otherwise do absolutely nothing to support them.

So polution in the bay doesn't impact you Dave? Cause is sure as heck impacts me! I know many others feel the same way ... My family and I do our part to help preserve the health of the bay ...... If you want to see what will happen to the island WITHOUT the proper attention, just look across the bay at Poplar Island. Federal, State and Local money is being spent in order to REBUILD the island. The erosion will eventually destroy the island if it is not maintained. The State and County do not have the funds. Let the owner develop the property in order to help eliminate the erosion and in the process help clean up the bay.

This MRA and Paul Spadaro thing is so way beyond done. It's not public land, who in their right mind would think so? Obviously, to most of us, no one would presume it to be so. I honestly believe Paul Spadaro just likes seeing his name in the newspaper, and the Capital certainly panders to him. Kristina P, Easton is absolutely incorrect when she states,"because what you do to that island directly impacts EVERYONE in state!!!" What happens on that island is none of my business, nor anyone else's. It has absolutely zero effect on me, no matter how many exclaimation points she uses.

Islands - July 15, 2008

Islands on the bay come and go, it's the natural process and how things should be. And what about all the wildlife that call Dobbins Island home? Ospreys Herons Ergerts Ect ..... I guess they have no rights since it is after all PRIVATE property. I don't understand why people aren't outraged by the loss of our wet lands and the buffer zones that should be protecting our bay ..... Once again if you have enough money you can rape the bay and pay people to look the other way. It makes me sick!!!

I agree that it is disgusting how money can buy anything in AAC. I do not understand how the average joe is not permitted to build a deck on the front of his waterfront home, but the big bucks Bob can buy an island, build a home and speed the process of destroying the land and the Bay!

Dobbins Island has been in the Dobbins family since 1851, I don't know why you believe the county ever owned or sold it. Mr. Clickner purchased this island and should have a right to build one house, just like every other resident in Anne Arundel County....I live here, paid for my lot and respect the same rights for others. Every one is always so kettle black to believe they can live on the water (regardless of the frontage) but retaliate against the next guy wanting to live on the water. Like John F. stated it's PRIVATE property, either fess up and buy it or zip it!

Sigh - July 15, 2008

It's funny. Dobbins left as it is will probably vanish almost completely in another 20 or 30 years. It has shrunk significantly sense I was a kid. I also remember some kids that died crawling around on it and because they fell to there death as the land crumbled beneath them. Selling it off to someone who has the means to actually develop it is probably the best way to in fact preserve it and I am not normally in favor of developing wild land. People have been trying to buy the island for years. My own dad attempted it about 25 years ago but they wouldn?t budge. No one but the county cared back then, now there?s this big uproar to preserve it when what?s going to happen is it will just continue to fall into the river and disappear. The MRA doesn?t have the funds to do anything let alone buy the property. It may be a little sad that people will no longer be able to crawl around on the island but they were not exactly supposed to before. I remember no trespassing signs on the island sense I was a kid in the 70's so proving the 20 year access thing wont be easy sense there has been no allowable access that I am aware of.

Well Louis I suggest that if you not want to be told to do with 'your island' that you not buy one ...... because what you do to that island directly impacts EVERYONE in state!!! The state/county has every right to regulate what people can and cannot do with land that directly runs into Chesapeake tributaries.

Firt of all the county should have never sold Dobbins in the first place. But this is another shining example on what is wrong with the Chesapeake Bay and why it's never going to be able to be resotred to a state of good health! If you have enough money in the state of Maryland you are free to rape the bay, and pay officals to look the other direction ..... it's absolutly disgusting!!!! We should be ashamed of the health of our bay and the lack of intrest to perserve it!

Families have been coming here for more than 20 years, I know that first hand. My son sniffs back tears every year when he sees the fences and can't climb on the cliff anymore. The county never should have sold the property in the first place, but Clickner could ask for a reasonable sum (not 20 times what he paid for it in 2004). This property should belong to the people. I think any reasonable person that has hiked the island would agree that it isn't environmentally sound to build a house there.

Property Rights - July 12, 2008

You're beating a dead horse. I'm all for safeguarding the environment but before Mr. Glicker purchased the property the MRA showed no interest in acquiring the land. Is the owner to wait forever for MRA to get its funding together? You're a day late and more than a dollar short. Perhaps if you stopped wasting you funds on frivolous repetitive law suits you may have enough money to acquire the land.
