It is unclear how much Joseph Francis Mosmiller will pay his three victims as part of the March 31 settlement. He was convicted in 2007 of misconduct in office for groping one of the women.
The settlement occurred out of court and attorneys for both Mosmiller and the women did not return numerous calls for comment. The Capital does not identify victims of alleged sexual crimes.

Ever since this story appeared I can't help but wonder why on earth someone would follow a police officer to a secluded area and then expose herself.Not to mention he left for like 10 minutes and returned.She could have just left and drove home or better yet used her cell to dial 911 and tell them that some cop made her follow him to a secluded area.I personally think she either made the offer or these two used too know each other and you never know,dated.

My friends, I respect this attorney for doing his job. The scenerio he proffered is not beyong the pale, it could quite well be feasible. The defense attorney did nothing wrong and his bold stance could have saved his client from a more severe penalty. Great lawyers--among them Joel Katz-- do not play by the rules, they write them.

My assumption Robert is that the officer's defense would be that these encounters were somehow consentual and that when you're flashing people you should assume you might be groped.
Now don't get me wrong, I'm not defending the officer in any way, shape or form. He's a pig (pun only sort of intended). But his lawyer has to do the best he can with what he has. Is it in poor taste to turn it back on the victims. Absolutely. But if his client tells him these were consentual acts, then he needs to make the case for his client.
My point is, blame the defendant but don't blame his attorney for representing him to the best of his ability. That's what we would want for ourselves if we were wrongly accused.

How in the world can anyone--much less an officer of the court--dare suggest that a reasonable person was negligent and liable for her own risk of injury when she was acting under the direction (however twisted) of a police officer?
