Teen in Christopher Jones death to be tried as juvenile

Capital Gazette Communications
Published 10/10/09

The older of two teens accused earlier this year of fatally punching a 14-year-old boy while he rode his bike in Crofton will be tried as a juvenile, a county judge ruled yesterday.

Find Us On Facebook

Javel George, 16, of Crofton, was originally charged as an adult with manslaughter in the May 30 death of 14-year-old Christopher Jones.

But over the objections of prosecutors, Circuit Court Judge J. Michael Wachs decided yesterday that it would be better for George and society as a whole if the teenager was tried in the juvenile system. He then ordered George to be transferred from the Jennifer Road Detention Center in Parole - where he has been...

my post is removed due to one word, so I will re-state

15 year old burned in Florida, 3 15 year olds charged as adults, hopefully the Broward judge will have the courage to proceed with these charges. Unlike our AA judge.

Teens speak out - 2009-10-13 19:54:09

I applaud you and other teens for speaking out!!! TEENS need to empower themselves with their School Administrators and STOP THE VIOLENCE. Haven't we learned enough from Columbine? That was over 10yrs ago? Bullying needs to be reported and reported and reported because that is the only way to FIX the problem. Teen should watch the movie PAY IT FORWARD until they can memorize the words! Yes, let's hope that students in the future will have more choices. The center that the Atkins family is planning is one answer. I hope that TEENS can get involved from both sides and start making better choices.

juvenile courts can handle this - 2009-10-13 18:17:25

As a child I attended our public schools. My parents were completely anti-violence and would not leet me associate with the gangs available for protection from bullying.Yes, I was bullied every day because of this, but when I was targeted by one gang to copy answers off of my tests, they would protect their interest by kicking the teeth in of those who bullied me. I was forced to participate in those beatings of rival gangs, and I know there is little other choice for our students if this issue is not taken seriously.

Disagree - 2009-10-11 23:41:14

My 15yr old son wrote the previous comment. I had a strong opinion different than him. But after we read the article and comments he wanted to post his own, so I let him with the appropriate initials at the end.

My own "child" opened my eyes a bit to that compassion that the Social Worker, Jennifer Beard, must have had when making her own decision....not easy ones for folks who have to work in these areas every day. My heart goes out to them and the victim. I can't imagine what Chris's mom must be feeling, the real guilty ones are the child's parents I think. We don't live in a world where folks take responsibility for their actions, do we? :(

Parents - 2009-10-11 22:13:01

A young boy, with (probably) crap for parents, and a GPA low enough to have Down's Syndrome, simply punches another child. Is this worthy of a life in prison of being sexually assaulted, beaten, and forced to live a life of terrible conditions that none of us could ever bear? NO! This CHILD was born into a lifestyle with unfortunate parents, unable to perform the disciplinary actions necessary to "set him straight" after previous troubles in school. Because this is his first offense, I feel that this child only needs disciplinary action (like Juvenile Hall) to "set him straight." The law says he is not an adult as 16, and I, as well as any other loyal American citizen, agree with the law. He should not be sent to an adult prison.

Worth asking... - 2009-10-11 13:48:36

According to this article, Javel George could have got as much as ten years if he was tried as an adult and found guilty of manslaughter. As a result of this development, he will likely be placed in juvenile detention until he turns 21; since he'll probably be closer to his 17th birthday by the time he's committed, I think we can all agree that that loosely translates to a sentence of four years.

What sentence would an adult convicted of a crime similar to this with a record similar to Javel George (which is to say technically none, sure to be counterbalanced with some unflattering character evidence) be likely to receive? If ten years is the MAXIMUM for manslaughter, would the more likely sentence for an adult be much more than four years after the muster of sentencing guidelines runs its course?

If not, I'm not sure juvenile detention is such a bad idea in this case. A lot of people are angry at this kid and rightfully so, but something tells me four years of rehabilitation designed for someone Javel George's age would do a lot more good for society than four years of hard time in the environment of a maximum security correctional facility (and for any sort of homicide by way of intentional acts, it would most certainly be a maximum security facility). Like Judge Wachs pointed out, "no matter what he does, Javel George will be back on the streets someday." Having him re-integrate with society four years from now as a different person than he was when he left was about the only way in which Judge Wachs could make any sort of difference in this case.

Child at 16? - 2009-10-11 02:40:54

Last I checked you can drive a car at 16, so that makes you a responsible ADULT! Operating, and navigating a 2 ton vehicle which you can kill with. We were ALL born with fists, with which Javel George and his accomplice chose to use them to kill with. He should be tried as an adult.

People , instead of wasting your time being angry with a Judge listen to his ruling and critique it. If the Judge fails to apply the law effectively, there is always the Appeals process.

The law works. Sure it takes a lot of money and perseverance, but it works. The problem is that most lawyers are pretty lazy and prefer plea deals. Make the facts work for you !!!!

What if was a 1 in 100 chance - 2009-10-10 21:12:56

Section (b) says transfer to juvenile court is allowed if transfer "is in the interest of the child or society."

Section (d) says "Transfer criteria.- In determining whether to transfer jurisdiction under subsection (b) of this section, the court shall consider:

(1) the age of the child; (16)

(2) the mental and physical condition of the child; (probably good except he's a sociopath)

(3) the amenability of the child to treatment in an institution, facility, or program available to delinquent children;

(4) the nature of the alleged crime (""It was a one in a million chance," Wachs said of the fatal punches);

(5) the public safety.

Yo tell us we do not understand the law yet you seem to miss that Jacklitsch is representing the family of Christopher Jones. He was present at the hearing but is not involved other than being the attorney representing a potential witness.

AA County is notorious for ridiculously lenient justice. Rapists, murderers, violent criminals, and drug dealers are routinely slapped on the wrist, but many other less serious crimes are offered much harsher penalties.

A shoplifter might get 6 months in jail. A rapist might get 9.

It doesn't matter if he was charged as a child or an adult. The judicial system in Maryland is a joke. If the kid got sentenced to the full 10 years in adult prison, he would be out in less than 2 with good time and parole. If he goes to a juvenile facility, he can stay in jail until he is 21 which is 4 years. One day he will be back in society and to prevent this from happening to another child, he needs to be sent where he can get the mental help that he needs. I commend the Mrs. Adkins for calling him a coward. Child or not, he took a like and can't even admit it or say he is sorry.

Also, Jaklitsch has nothing to lose in this battle ( he is in it for the money as he will be suing the alleged perpetrator civilly for monetary damages) and should not have argued anything in court--it is very unclear if hometown annapolis is describing a legal argument or a rhetorical one in an interview. if people are angry be angry at the lawyer that could not effectively persuade a Great judge to share their skewed view of the LAW.

Fred were you in the court room? Sounds like you are pretty good at making assumptions as well. I think people are probably angry because an innocent kid was murdered. Now we are suppose to blame the lawyer?

He is 16, he is a kid, He is hardly an adult. despite the community's racial bias and lynch mob mentality this judge has successfully done his part as a disinterested arbiter of fact and simply applied the law . Justice has been served.

If the People want to be angry, point the finger at Jaklitsch for failing to successfully represent the best interest of his client. Lawyers are lazy and I am sure Jaklitsch simply assumed he had to show up and any Judge would bow to public opinion.

Still doesn't admit any wrong doing! We haven't seen the last of him and I am willing to bet he will end up in adult prison eventually, when he kills SOMEONE ELSE!
